Terms of Service

1. Acceptance of Terms

By creating an account or using the SMST/APA Tool platform (“Service”) operated by Jula Consultancy FZE (“Company”, “we”, “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

SMST/APA Tool provides a web-based strategic management platform incorporating African-inspired PESTLE analysis, SWOT analysis, report generation, and team collaboration features. Features vary by subscription plan.

3. Account Registration

You must provide accurate and complete information when registering an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@smstapa.com of any unauthorised use.

4. Subscription and Billing

• Paid plans are billed on a monthly or annual basis as selected at checkout.
• A free trial period may apply to new subscriptions; the trial length is shown at the time of purchase.
• Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time from your account settings.
• Refunds are considered on a case-by-case basis. Please contact us within 7 days of a charge if you believe a refund is warranted.

5. Acceptable Use

You agree not to misuse the Service. Prohibited conduct includes, but is not limited to: violating applicable laws; uploading malicious code; attempting to gain unauthorised access to any part of the platform; reverse engineering or scraping the Service; and reselling or redistributing access without written permission.

6. Intellectual Property

All platform software, content, branding, and methodology (including the African PESTLE framework as published in the ESG book) remain the intellectual property of Jula Consultancy FZE or its licensors. You retain ownership of the content (analyses, reports) you create within the platform.

7. Team Accounts

If you manage a team account, you are responsible for ensuring that all team members comply with these Terms. You may invite and remove members within the limits of your plan. Shared reports and analyses may be accessed by all team members you have granted access to.

8. Disclaimer of Warranties

The Service is provided “as is” without warranty of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements. Any strategic insights or reports generated are for informational purposes only.

9. Limitation of Liability

To the maximum extent permitted by law, Jula Consultancy FZE shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sharjah, U.A.E.

11. Changes to Terms

We may update these Terms at any time. We will notify you of material changes at least 14 days in advance via email or an in-platform notice. Continued use after the effective date constitutes acceptance of the updated Terms.
